But it is also worth pointing out that Traxxas didn't actually win the case. In Face, Traxxas has NEVER WON in court. With all of the various Traxxas lawsuits, the defendant has either A) fought it and gone bankrupt(Hobbico, HPI) , or 2- Settled to stop the lawsuit. (Horizon, Fireland, Redcat). Patent Law is an expensive game, and normally, he who has the deepest pockets wins.

Wasn’t there something about the judge there in Texas who seemed to rule in favor of those suing for patent infringement cases though?
 
BillDeLong as a long post about boycotting Traxxas over on RCGroups where he references this judge who is friendly to ALL patent lawsuits, not just Traxxas lawsuits. Being friendly in this case, to me, means he is not throwing out the cases of 'gasket on a box' patents, or 'laydown shocks'. These are ridicules patents, and should not have even gotten a patent, nevermind a trial. By keeping the trial going, the judge is forcing both parties to keep paying lawyers. This hurts the defendant more than Traxxas. Traxxas probably has a lawyer on staff, and can submit in-house documents, so the case is not too expensive. I'd guess most other hobby mfgrs don't keep a trial lawyer and a patent lawyer on staff, so now they have to pay big $$$ billable rates to lawyers and expert witnesses and others that have no interest in keeping the trial short.

TLDR, The friendly judge does not have to give Traxxas a final "you win", all he has to do is keep the machine running and it will grind down the other guy.
