I just purchased an infraction 3s, do you have to have a spektrum smart battery for the lights to work on the smart battery level on the controller?

SMC batteries are way better than any Spektrum Smart battery anyway. The Spektrum batteries are not worth the money just to be able to have the battery level on you transmitter. SMC are top quality batteries.
